Boston Naval Shipyard & Asbestos Use

Located in Charlestown, Massachusetts, the Charlestown Navy Yard was among the first shipbuilding sites in the nation. It operated from 1801 to 1974, and has been referred to as the Boston Naval Shipyard since 1945. Like many other shipyards in the United States, the Boston Naval Shipyard used asbestos.

The Secretary of the Navy opened the Boston Naval Shipyard to build vessels for the country’s defense and to repair those that had been damaged. The USS Independence was the first vessel built at the Boston Naval Shipyard, and many other Navy ships followed. Destroyer escorts, barrack ships, submarines, destroyers,  tank landing ships and motor tugs were among the ships constructed at the Boston Naval Shipyard. The Boston Naval Shipyard was also used to repair and store Navy vessels.

During World War II, the Boston Naval Shipyard employed a record-high 50,000 workers. This was mostly because of an array of attacks from German submarines that destroyed and sank a number of naval vessels.

The Massachusetts shipyard employed a variety of workers including blacksmiths, shipbuilders, machinists, electricians, sail makers, plumbers and carpenters. Although the health effects of asbestos exposure were recorded as early as the 1920s, those working with the mineral were unaware of its dangers until the mid to late 1900s. As a result, many workers, including shipbuilders, Navy veterans and naval contractors, may have been exposed to asbestos fibers in dangerous amounts. Although the Navy banned asbestos use in 1973, many workers had already been exposed to the harmful mineral.

In 1974, the Boston Naval Shipyard was shut down as part of a government cost-saving plan. As the dangers of asbestos became public in the 1970s, any asbestos products at the shipyard had to be cleaned up and removed properly. Several acres of the Boston Naval Shipyard are now part of the Boston National Historical Park.

Four Year Strong is an American pop punk band from Worcester, Massachusetts, formed in 2001. The band’s sound can be described as a blend of pop punk, Hardcore punk, and power pop. Four Year Strong have released three studio albums with the latest, Enemy of the World, released on March 9, 2010.

Dan O’Connor, Alan Day and Jake Massucco all attended Doherty Memorial High School in Worcester, Massachusetts, and eventually ended up meeting through introductions from mutual friends. The band was originally named A Four Year Strong. After the departure of the original bassist, two or three years after their initial formation, the band met Joe Weiss, eventually asking him to fill the position as the band’s bassist.

Four Year Strong’s earlier songs did not feature keyboards or synthesizers, but the instruments were incorporated eventually. The band cycled through many keyboardists, recruiting their current keyboardist Josh Lyford in late 2006.The band’s debut album, It’s Our Time was released on January 29, 2005.

The band has done multiple national tours, sharing the stage with such bands as The Starting Line,Hellogoodbye, From First to Last, Every Time I Die, Meg & Dia, Hidden in Plain View,Anti-Flag,Alexisonfire, All Time Low, Mayday Parade, New Found Glory, Bayside and Steel Train. The band toured in February-April 2009 as part of the Taste of Chaos tour, alongside Thursday, Bring Me the Horizon,Pierce the Veil, and Cancer Bats. They undertook the Summer co-headline tour with Set Your Goals, and also Fireworks, The Swellers, Polar Bear Club, A Loss For Words, Drive A and Grave Maker from July to August 2009. Four Year Strong also performed on the Australian Soundwave festival in February and March 2010. The band have also been announced in the lineup for Vans Warped Tour 2010. Current Health Insurance Reform Issues

No sooner had President Obama signed the last piece of the health care reform package on March 30 than he hit the road, traveling to a number of states to sell the public on the new health care law of the land. On their Easter/Passover recess break, many members of Congress were engaged in their own hearts and minds campaign on health reform back in their home districts. A new Gallup poll, however, seems to show that Democratic supporters of the bill have the tougher selling job. The poll shows that 47 percent of Americans believe it is a good thing that the bill passed while 50 percent believe it to be a bad thing. And, the results show that both opponents and proponents agree that the new law does not do nearly enough to address rising health care costs. Health plans, such as Aetna, have maintained that the success of health care reform will hinge on addressing health care costs, and we have pledged to continue working toward reforms that would achieve affordability.

Since Congress was in recess last week, there is no Federal report this week.

States

ARIZONA: After a lengthy debate in special session, the legislature voted along party lines to permit a lawsuit challenging the newly enacted federal health care reform law. It is unclear whether Governor Jan Brewer will join other states in the lawsuit filed in Florida, since the attorney general has advised that he will not participate in any litigation on this issue. Brewer had asked lawmakers for authority to go around the attorney general and sue on the state’s behalf.

COLORADO: A bill prohibiting the use of gender as an underwriting factor in setting rates for individual policies passed both chambers and will become effective with plans issued or renewed after January 1, 2011. The bill is part of Governor Ritter’s health reform package.

GEORGIA: A bill that originally would have imposed a tax on health plans – the language regarding a health plan tax was removed recently — was passed out of the Senate last week. However, whether the Governor will sign the bill in its current form is not clear.

IDAHO: The legislature adjourned a week early last week, but not before passing a number of items to close out the session. Governor Otter has signed a number of the bills, including the “Idaho Health Freedom Act”, reserving citizens’ right to choose or decline health care services without being penalized by the federal government and authorizing the state attorney general to seek legal recourse to uphold this policy. He also pointed out that the state can opt out in 2017 if it can demonstrate that it could provide similar coverage. So you always have to plan on the basis you will be in for a fight if you make a claim. That means opening and keeping an up-to-date file on everything you say to the insurer about the policy and any claims you might make. The more comprehensive your records the better. If you must speak to a representative of the company, whether in the flesh or on the phone, get a name and always write a letter confirming what was said and what, if anything, was agreed. Yes, it will take up a few minutes of your time. But you should always be able to produce contemporaneous records — a day-by-day record of representations, promises and action (or the lack of it). You are rolling your eyes. All that hassle. Why bother? Let’s take Massachusetts as an example. Five of the largest companies insuring vehicles all managed to make the same data entry mistake. They had a paper trail for every claim and, when they reported the behavior of the insurers to the State Attorney General, this resulted in fines paid by the companies and a recalculation of all the premiums with a full refund to everyone affected. Sadly, auto insurance is a bear pit and, if you are going to come within range of the bear, you had better be prepared with full information. It does not matter whether you are on cheap car insurance, usually the mandatory liability minimum, or a comprehensive/collision policy with all the bells and whistles, document every aspect of your relationship with the insurer and every detail of any claim you make. If anything goes wrong, every state has a Department or Office of Insurance. Make a formal complaint if you think you are losing out. If you learn of others, complain to the State Attorney General. Failure to fight means the companies will trample on your rights.
