Feature: Marc Breakstone of Breakstone, White & Gluck

Posted in Massachussets on 15.03.10

Marc Breakstone discusses problems with spine surgery in Boston.

Finding that over 11 spinal fusion surgeries were carried through in the wrong area of the spine since 2006, a Boston Globe study has identified the spine as the area of the body most often involved in hospital mistakes. Boston medical malpractice attorney Marc Breakstone, who is presently representing a client that experienced one of these problematic spinal operations, emphasizes that although there are many explanations for why spine surgery is subject to so many errors, the number of mistakes since 2006 is indefensible. For the full story see “But it’s still inexcusable; it shouldn’t happen.”  Boston Globe, July 30, 2008.

Marc Breakstone criticizes handling of evidence in ventilator case.

Immediately following the death of a fifteen-year-old boy with cerebral palsy who died when his ventilator stopped working during a power outage, police sent the ventilator back to its manufacturer. As attorney Marc Breakstone emphasizes, this is problematic because it has prevented the boy’s family from retaining the ventilator, a vital piece of evidence in this case, putting them in desperate need of a legal representative. Boston Globe, July 24, 2008.

Marc Breakstone and Ronald Gluck cast doubt on Massachusetts Medical Society claims

Posted in Massachussets on 02.03.10

Marc Breakstone, Boston Personal Injury Lawyer and Ronald Gluck, Boston Medical Malpractice Attorney of the Boston based Legal Firm Breakstone, White & Gluck have publically cast their doubts on The Massachusetts Medical Society claims regarding defensive medicine.

They are considered expert sources on this subject and were quoted saying the following “The Massachusetts Medical Society has suggested that “defensive medicine” is significantly increasing health care costs in Massachusetts. The MMS had claimed that doctors are ordering more than a billion dollars yearly for unnecessary tests out of their typically unncecessary concern for medical malpractice.”

As Marc Breakstone, a Personal Injury Lawyer from the Boston law firm Breakstone, White & Gluck told the Boston Globe, “properly managed care reduces the likelihood of unnecessary medical spending.”

Marc Breakstone discusses problems with spine surgery in Boston

Marc Breakstone discusses problems with spine surgery in Boston.

In a study of hospital errors during surgery conducted by the Boston Globe, the spine was identified as the area most likely to be involved. The report found that there had been 11 surgeries conducted at the wrong level of the spine since 2006. The operations often involved fusion surgery conducted at the wrong level. “While it would be a clear departure from the standard of care to operate at the wrong level of the spine, there are more reasons – perhaps not good reasons – why that could happen,” said Marc L. Breakstone, a Boston Medical Malpractice Attorney currently representing a client who sued over a spine operation performed earlier this decade. “But it’s still inexcusable; it shouldn’t happen.”  Boston Globe, July 30, 2008.
